Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs use of all NeuroByte LLC ("NeuroByte") websites, products, tools, and services (collectively, the "Services"). It is incorporated by reference into the NeuroByte Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service.

By using the Services, you agree to comply with this AUP. Violations may result in suspension or termination of your access, with or without notice.

1. Prohibited Uses

You agree not to use the Services to:

1.1 Illegal or Harmful Activity

  • Violate any applicable law, regulation, or third-party right
  • Engage in fraud, money laundering, or other financial crimes
  • Facilitate human trafficking, child exploitation, or other crimes against persons
  • Distribute malware, ransomware, or other malicious code
  • Engage in unauthorized access, intrusion, or surveillance of any system

1.2 Harmful or Abusive Content

  • Upload, transmit, or generate content that is defamatory, obscene, harassing, threatening, or hateful
  • Engage in stalking, doxing, or targeted harassment
  • Generate or distribute non-consensual intimate imagery
  • Generate content sexualizing minors

1.3 Intellectual Property and Privacy Violations

  • Infringe any copyright, trademark, trade secret, or other intellectual property right
  • Process personal data without lawful basis or required consent
  • Record, intercept, monitor, or transcribe any call, voicemail, or other communication without obtaining every notice and consent required by applicable law from all parties to that communication in each applicable jurisdiction, including any all-party (two-party) consent required under wiretap, eavesdropping, or interception laws such as the federal Electronic Communications Privacy Act and the California Invasion of Privacy Act
  • Send automated, prerecorded, or bulk calls, text messages, or other communications without obtaining the consents, and providing the disclosures and opt-out mechanisms, required by applicable law, including the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act
  • Violate the privacy or publicity rights of any person
  • Track, monitor, or determine the precise geolocation of any individual without a lawful basis and any consent required by law
  • Circumvent or attempt to circumvent any technical measures protecting content

1.4 Service Integrity

  • Interfere with or disrupt the Services, servers, or networks connected to the Services
  • Attempt to gain unauthorized access to the Services or related systems
  • Probe, scan, or test the vulnerability of any system without express written permission
  • Reverse engineer, decompile, or disassemble the Services, except as expressly permitted by law
  • Use the Services to develop a directly competing product or service
  • Use bots, scrapers, or automated means to access the Services other than through documented APIs and within published rate limits
  • Use the Services to access, scrape, harvest, or collect data from any third-party website, platform, or system in violation of that third party's terms of service, technical restrictions, or applicable law
  • Resell, sublicense, or otherwise commercially exploit the Services without our written consent

1.5 AI-Specific Restrictions

The Services may incorporate artificial intelligence and machine learning. You agree not to use any AI capabilities of the Services to:

  • Generate content intended to deceive, defraud, or impersonate any person without their consent
  • Generate disinformation, fake news, or content designed to manipulate elections or political processes
  • Generate content that violates any of the prohibitions in Sections 1.1 through 1.4
  • Make consequential decisions about individuals (in areas such as employment, credit, housing, healthcare, or law enforcement) without appropriate human review
  • Train, fine-tune, or improve any third-party AI or machine learning model without our express written permission
  • Extract, reproduce, or attempt to derive the underlying models or weights powering the Services
  • Bypass, disable, or circumvent any safety, content moderation, or rate-limiting features

1.6 Sensitive Data

Without a written agreement explicitly authorizing it, you agree not to submit to the Services:

  • Government-issued identification numbers (Social Security numbers, driver's license numbers, passport numbers)
  • Full payment card numbers (other than through our designated payment processor)
  • Health information that is regulated under HIPAA (Protected Health Information)
  • Information about children under 13
  • Biometric identifiers or biometric information (such as voiceprints, faceprints, or fingerprints) regulated under laws such as the Illinois Biometric Information Privacy Act (BIPA)
  • Other categories of data subject to heightened legal protection

If your use case requires processing such data, contact us before doing so. Any written agreement authorizing biometric identifiers or biometric information must include the notice, consent, retention, and destruction terms required by applicable biometric privacy laws, and Client remains responsible for obtaining any required end-user consent.

2. Reporting Violations

If you become aware of a violation of this AUP, please report it to [email protected] with as much detail as you can provide. We investigate reports in good faith.

3. Enforcement

NeuroByte reserves the right, but is not obligated, to investigate any suspected violation of this AUP. We may take any action we consider appropriate, including:

  • Issuing a warning
  • Removing content
  • Limiting account functionality
  • Suspending the account
  • Terminating the account
  • Reporting activity to law enforcement or regulators
  • Pursuing civil or criminal remedies

We may take action with or without prior notice, depending on the severity of the violation. We are not liable for actions taken in good faith to enforce this AUP.

For violations that pose an immediate threat to the security, integrity, or availability of the Services or to any person, we may suspend access immediately and provide notice afterward.

Handling, return, and destruction of Client Data and Confidential Information following any suspension or termination under this Section are governed by the return-of-data provisions in Section 14.4 (Effect of Termination) of the Terms of Service.

If you believe your account was suspended or terminated in error, you may request review by emailing [email protected]. NeuroByte will consider reinstatement requests in its sole discretion and is under no obligation to reinstate any account.

4. Updates

We may update this AUP from time to time. For material changes we will provide notice through the Site and, where the change materially affects your obligations, by email to account holders before the change takes effect where practicable. Because this AUP reflects our legal and safety obligations, changes may take effect immediately where required to comply with law or to address a security or safety risk. Your continued use of the Services after the effective date of any update constitutes acceptance. The right of paying Clients to reject certain changes described in the Terms of Service does not apply to this AUP.
